Terms of Service
In short: Vaartix lets you send transactional email through an API. You keep ownership of your data and are responsible for what you send. Follow our Acceptable Use Policy. The service is free during the private beta and comes without guarantees; paid plans will be billed in rupees and announced at least 30 days before they apply to you.
1. The agreement
These terms are an agreement between you and NAP Designs, India ("we", "us"), which operates Vaartix. By creating an account, using an API key or otherwise using Vaartix, you accept these terms. If you use Vaartix for a company, you confirm that you can accept these terms for it, and "you" means that company.
The Acceptable Use Policy and the Privacy Policy form part of these terms.
2. The private beta
Vaartix is in private beta. During the beta:
- The service is free. We will not charge you without you first choosing a paid plan.
- Features, limits and the API may change. We will try to give notice of breaking changes in the changelog.
- There is no uptime commitment or service level agreement.
- We may limit, pause or end access to the beta, and we will tell you before we do so unless there is an urgent security or abuse reason.
3. Your account
- Give accurate details when you sign up, and keep them up to date.
- Keep your API keys and login secure. You are responsible for everything done with your account and keys. Tell us at [email protected] straight away if you believe a key has leaked, and revoke it.
- You must be at least 18 years old and able to enter a binding contract under Indian law.
4. What you send
You are responsible for the email you send through Vaartix, including its content, its recipients and having permission to email them. You must follow the Acceptable Use Policy and the law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
To protect deliverability for all customers we apply sending limits, suppress addresses that hard bounce or complain, and pause sending automatically when bounce or complaint rates are too high.
5. Your data
You own the email content, recipient addresses and other data you send through Vaartix ("Customer Data"). You give us permission to process Customer Data only to provide, secure and support the service. For personal data in Customer Data you are the Data Fiduciary and we act as your Data Processor, as described in the Privacy Policy. Customer Data is stored in India (AWS Mumbai region).
6. Fees and taxes
- Paid plans, when they launch, will be priced and billed in Indian rupees, with GST charged as applicable and a GST invoice for every payment.
- We will publish prices on our pricing page and tell you at least 30 days before any fee applies to you or any price changes.
- Fees are payable in advance for each billing period and are not refundable except where the law requires.
- If a payment fails, we may reduce your account to the free plan's limits after telling you.
7. Suspension and ending the agreement
You can stop using Vaartix and close your account at any time by writing to [email protected].
We may suspend or close your account if you break these terms or the Acceptable Use Policy, if your sending puts the service or other customers at risk, or if the law requires it. Where we reasonably can, we will tell you first and give you a chance to fix the problem.
After your account closes, we delete Customer Data as described in the Privacy Policy, except data we must keep by law and suppression entries needed to stop unwanted email.
8. Our intellectual property
Vaartix, its software, documentation and brand belong to NAP Designs. We give you a limited, non-exclusive, non-transferable right to use the service and our SDKs to send email for your own products while these terms apply. Our SDKs and code samples may come with their own open-source licences, which apply to them.
If you send us feedback or suggestions, we may use them without any obligation to you.
9. Confidentiality
Each of us will keep the other's non-public information confidential and use it only for this agreement, unless it becomes public through no fault of ours or the law requires disclosure.
10. Disclaimer
Email delivery depends on recipients' mail providers, which we do not control. We cannot guarantee that any email will reach an inbox. Except as these terms expressly say, Vaartix is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
11. Limitation of liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential losses, or for lost profits, revenue or data. Our total liability for all claims under these terms is limited to the greater of the fees you paid us in the 12 months before the claim and ₹10,000. These limits do not apply to your payment obligations, to your breach of the Acceptable Use Policy, or to liability that cannot be limited by law.
12. Indemnity
You will defend and compensate us against claims by third parties that arise from the email you send through Vaartix or from your breach of these terms or the Acceptable Use Policy.
13. Changes to these terms
We may update these terms. We will post the new version here and, for material changes, tell you by email at least 30 days before they take effect. If you keep using Vaartix after that, the new terms apply.
14. Law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute informally; if that fails, the courts in India with jurisdiction over NAP Designs' principal place of business have exclusive jurisdiction.
